1. Who We Are

PRESTO is operated by SPARQ Innovations, LLC, a company organized under the laws of Puerto Rico. References to "PRESTO," "we," "us," or "our" in this policy mean SPARQ Innovations, LLC. Our platform provides:

• Real estate listing search and monitoring across Puerto Rico sources (ClasificadosOnline, FindItPR, and others)
• AI-powered property analysis and investment scoring
• Property management tools: leases, tenants, rent collection, maintenance tracking, expense logging
• Condo regime and short-term rental (STR) compliance management
• Vendor and contractor rolodex with dispatch
• ATH Móvil payment link generation for landlord-tenant rent collection

2. Information We Collect

Information you provide directly:

• Account data: name, email address, and password (managed via Clerk authentication). If you sign up with Google or another OAuth provider, we receive only the profile data that provider shares.
• Subscription & billing: your plan tier (Essential, Professional, or Investor). Payment card data is processed by our payment processor and never stored on our servers.
• Property data: addresses, unit details, purchase price, rental rates, property photos (if uploaded), and other details you add to your managed properties.
• Tenant data: tenant names, email addresses, phone numbers, WhatsApp numbers, lease terms, rent amounts, payment history, and maintenance requests. This data is entered by you and belongs to you.
• Financial data: rent payments, expenses, receipts (including images you upload for OCR processing), and ledger entries you create.
• Documents: lease agreements and other documents you generate or upload through the platform.
• Vendor data: contractor names, trades, phone numbers, email addresses, and notes you enter into your vendor rolodex.
• Search keywords: property search terms and filters you use to track listings.
• Support communications: emails, messages, or feedback you send to us.

Information collected automatically:

• Usage data: pages visited, features used, search queries performed, and actions taken within the platform (e.g., analyses run, keywords tracked).
• Device and log data: IP address, browser type, operating system, referring URLs, and timestamps of requests.
• Session data: authentication session tokens managed by Clerk.
• Cookies and local storage: see Section 11 for details.

Information from third parties:

• Property listing data: we scrape publicly available property listings from third-party websites on your behalf when you perform a search.
• Geospatial data: coordinates from OpenStreetMap (Nominatim), flood zone data from FEMA NFHL and Puerto Rico SIGEJP, and parcel data from the CRIM (Centro de Recaudación de Ingresos Municipales) GIS portal.
• CRIM property tax data: publicly accessible catastro and tax assessment data retrieved via CRIM's web service.
• Authentication providers: if you use Google Sign-In or another OAuth provider via Clerk, we receive your name and email from that provider.

3. How We Use Your Information

We use the information we collect to:

• Create and maintain your PRESTO account
• Provide property search, monitoring, and AI analysis features
• Run and display your property management portfolio (properties, tenants, leases, financials)
• Generate rent payment links via ATH Móvil and record payment confirmations
• Process and store expense records, including OCR extraction from uploaded receipts
• Send automated reminders — rent due notices, lease expiration alerts, maintenance follow-ups, cuota late notices, and STR license expiration alerts — via email and/or WhatsApp
• Generate lease agreements and other documents on your behalf
• Enforce subscription limits (keyword tracking quotas, property limits by plan)
• Improve the platform, fix bugs, and develop new features
• Respond to your support inquiries
• Comply with applicable legal obligations

We do not use your data to train third-party AI models, sell advertising, or share your information with data brokers.

4. Tenant & Third-Party Data

As a landlord or property manager using PRESTO, you may enter personal information about your tenants and other third parties (e.g., vendors, maintenance contacts). You are the data controller for that information. We process it on your behalf as a data processor.

You are responsible for:

• Obtaining any necessary consent from tenants and third parties before entering their data into PRESTO
• Complying with applicable privacy laws in your jurisdiction regarding tenant data
• The accuracy of the data you enter

Tenant-facing pages (e.g., ATH Móvil payment links, lease PDFs) may display your tenant's name and payment amount. These pages are accessed via unique, unguessable URLs and are not indexed by search engines.

When you send automated reminder emails or WhatsApp messages to tenants through PRESTO, those messages are sent from our infrastructure on your behalf. Tenants who receive such communications may contact us at the address in Section 14 to request removal from future automated messages.

5. Property Listing Data

When you search for properties, PRESTO scrapes publicly available listing data from third-party real estate websites (currently ClasificadosOnline and FindItPR). This data — titles, prices, descriptions, addresses, listing IDs, and listing URLs — is stored in our database associated with your account.

We use geospatial APIs (OpenStreetMap, FEMA, Puerto Rico SIGEJP/CRIM) to enrich listings with flood zone, parcel, and municipality data. These API calls may include the property coordinates or address but do not include your personal account information.

Scraped listing data is used solely to provide the search and monitoring features you requested. We do not resell scraped listing data.

6. How We Share Information

We do not sell your personal information. We share data only in these circumstances:

• Service providers: we use Clerk (authentication), our cloud hosting provider (server infrastructure), and transactional email/SMS providers. These vendors process data only as necessary to provide their services to us, under contractual data processing obligations.
• Payment processors: ATH Móvil receives transaction data when your tenants make payments via payment links you generate. We receive only a transaction confirmation and ID — no raw card data.
• AI analysis: when you run a property analysis, listing data (title, price, description, location) is sent to Anthropic's Claude API to generate an investment score and summary. No tenant PII is included in these requests. Anthropic's data use is governed by their API terms.
• Legal requirements: we may disclose information if required by law, subpoena, court order, or to protect the rights, property, or safety of PRESTO, our users, or the public.
• Business transfers: if SPARQ Innovations, LLC is acquired or merges, your data may transfer to the successor entity. We will notify you beforehand.

7. Payments & Financial Data

PRESTO subscription billing is handled by our payment processor. We store only your plan tier and billing status — not your card number, CVV, or bank account details.

ATH Móvil payment links are generated using ATH Business credentials you provide and store in your account. Your ATH Business private token is stored encrypted at rest. We use it only to verify incoming payment transactions on your behalf. We do not initiate charges to your tenants — the payment links you share are tenant-initiated.

Rent payment records created in PRESTO (amount, date, description) are part of your financial ledger and are stored on our servers. You may export or delete this data at any time from your account settings.

8. Data Retention

We retain your account data for as long as your account is active. If you close your account, we will delete or anonymize your personal data within 90 days, except where retention is required by law (e.g., financial records).

Property listing data (scraped listings) is retained indefinitely to support price-history tracking and alert features. You may delete individual listings from your dashboard at any time.

Server logs are retained for up to 90 days for security and debugging purposes.

9. Security

We implement industry-standard security measures including:

• HTTPS/TLS encryption for all data in transit
• Encryption at rest for sensitive credentials (ATH Business tokens)
• Authentication managed by Clerk, a dedicated identity platform, with support for multi-factor authentication
• Access controls limiting data access to authorized personnel
• Regular dependency updates and security patching

10. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access: request a copy of the personal data we hold about you
• Correction: update inaccurate or incomplete data
• Deletion: request deletion of your account and associated personal data
• Portability: receive your data in a structured, machine-readable format
• Objection: object to processing of your data for certain purposes
• Withdraw consent: where processing is based on consent, withdraw it at any time

As a Puerto Rico-based business serving users in the United States, we comply with applicable U.S. federal privacy requirements. California residents may have additional rights under the CCPA/CPRA.

11. Cookies & Tracking

PRESTO uses the following browser storage mechanisms:

• Session cookies: set by Flask (our web framework) to maintain your login session. These are essential and cannot be opted out of while using the platform.
• Clerk authentication cookies: set by our authentication provider to manage your signed-in state.
• Local storage: we store your keyword last-viewed timestamps and UI preferences (e.g., active filters, sort order) in your browser's local storage. This data never leaves your device.
• Session storage: we use session storage to cache active search job state so results survive page refreshes. This clears when you close your browser tab.

We do not use advertising cookies, cross-site tracking pixels, or analytics SDKs that report to third parties.

12. Children

PRESTO is intended for use by adults (18 years and older) who are property owners, managers, or real estate investors. We do not knowingly collect personal information from anyone under 18. If you believe a minor has created an account, contact us and we will delete it promptly.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or by a notice within the platform. Your continued use of PRESTO after changes take effect constitutes your acceptance of the revised policy.
